ShareMyPlaylists Gets A Much Needed Android Reboot

SMPAndroid1"To be honest, it was awful", says ShareMyPlaylists founder Kieron Donoghue on the company's previous Android effort, which today gets a much needed reboot. The new app brings many of the Spotify community site's best features to Google's platform, such as its editorally-picked 'Featured Playlists' as well as the 'Top 50 Playlist Charts'. Although be warned: Android users need a premium Spotify account to join the fun. Launched in 2009, ShareMyPlaylists.com claims to be the largest and oldest Spotify community site (it certainly feels like I've been covering the company for a very long time) and has published over 95,000 playlists for its users worldwide, while the site generates 15,000 playlists plays per-day and has over 300 new playlists uploaded daily.

Florida Panthers place two players on waivers as free agency approaches

The Florida Panthers made a number of roster moves in preparation for the start of free agency on Sunday. On Thursday, the Panthers placed forwards Matt Bradley and Mike Santorelli on waivers.

Bradley was placed on unconditional waivers ? which means he will not return. Florida will buy out the remainder of Bradley?s contract and pay him two-thirds of the $1 million owed to him over the next two seasons.

Bradley played in just 45 games with the Panthers last year because of a couple of injuries ? including a concussion suffered in February against the Ducks. That injury basically ended his season even though he practiced with the team during the playoffs.

Santorelli was placed on regular waivers, and although Florida could still bring him back, it is not likely. Santorelli is owed $1.6 million for next season so Florida would owe him almost $1.1 million over the next two years ? if he isn?t claimed by another team off re-entry waivers.

Santorelli signed a two-year deal with the Panthers after he had a breakout year in 2010-11 by scoring 20 goals and playing in all 82 games. But Santorelli missed the start of the year with a shoulder injury and never got on track offensively ending with nine goals in 60 games. Santorelli played in just one of Florida?s final 12 regular-season games and sat the entire postseason.

Florida also made qualifying offers to nine restricted free agents ? including roster players Kris Versteeg, Dmitry Kulikov and Keaton Ellerby ? on Monday. Wotjek Wolski, who made $4 million last season from the Rangers and Panthers, was not tendered an offer and is a free agent. He will be eligible to sign with any team ? including the Panthers ? starting Sunday.

Fiscal woes in Europe and sluggish job growth in the United States have put downward?pressures on oil prices. As a result, gasoline prices declined in all but two states over the past month, dropping 7.1 percent across the country. In many of these, gas prices are on the verge of falling below $3 per gallon.

Despite the overall decline, the range between gas prices among states is still wide. 24/7 Wall St.?examined?AAA?s Daily Fuel Gauge Report to determine?the 10 states whose residents pay the least at the pump. We found that the most decisive factor in determining gas prices is?location. Most of the states with low gas prices are located on or near the Gulf of Mexico. They also have among the lowest gas taxes in the country.

Five of the 10 states with the lowest gas prices are located?on the Gulf Coast, where a disproportionate amount of crude oil is processed. Furthermore, among the five states not on the Gulf Coast, three?border?the coastal states. Residents of these three states benefit from lower costs of transporting oil.

?Gulf Coast states benefit from having ready access to the refineries that are in the region,? says AAA spokesperson Michael Green. ?In fact, Gulf Coast refineries produce the most gasoline of any region in the country, and generally have a surplus, which means they?re sending gasoline that?s made in Gulf Coast refineries to other parts of the country.?

The states with the lowest gas prices have seen a more precipitous decline in those prices compared to the rest of the country. South Carolina and Mississippi, the states with the two lowest gas prices, now enjoy 9.1 percent lower prices compared to a month ago. Green points out that West Texas Intermediate (WTI)?crude oil, which is produced primarily in the Gulf Coast region, is cheaper than other forms of crude and has seen a faster decline in price.

24/7 Wall St.: The most dangerous cars in America

Another factor?determining gas prices is a?state?s?gasoline tax. All but two of the states on this list are in the bottom half of states in terms of total taxes charged, which include a federal 18.4 cents a gallon tax and state taxes. But the relationship between gas taxes and prices is far from perfect. Alaska has the lowest gas tax but the second-highest gas prices. The states with the second- and third-lowest gas taxes, Wyoming and New Jersey, did not make our list.

While not always the case, transportation costs in the states on 24/7?s list tend to be lower than the national average. Nine of the 10 states are in the lower half of states in terms transportation costs, while?three?are in the bottom 10 states.

AAA provided 24/7 Wall St.?with?the most recent available average price of regular unleaded gasoline by state. The organization also provided prices from one week, one month and one year ago. 24/7 Wall St.?also?examined the number of refineries and total refining capacity as of January 1 of this year, provided by the U.S. Energy Information Administration. The American Petroleum Institute provided state gas taxes, which were also as of the beginning of this year. This includes state gas excise taxes, as well as other taxes (including sales tax).

These are the 10 states with the cheapest gas.

1. South Carolina

  • Regular gas price per gallon:?$2.99
  • Tax per gallon:?16.8 cents (4th lowest)
  • Number of operating oil refineries:?0

South Carolina has the lowest average gas prices in the nation, and is the only state currently under the $3 per gallon mark. Compared to last year, gasoline prices in the state have decreased by 10.5 percent -- tying Mississippi for the highest proportional decrease in the country. Low prices in South Carolina are likely due in part to the low tax per gallon of 16.8 cents, which is the fourth lowest in the country. South Carolina?s prices have fallen by about 19 percent since their early April peak of $3.70.

2. Mississippi

  • Tax per gallon:?18.8 cents (7th lowest)
  • Number of operating oil refineries:?3

Gasoline prices are down about 18 percent from Mississippi?s yearly peak in the first week of April. The state ranks among the lowest in total taxes and fees per gallon of gas, which help keep its fuel prices low. The three refineries in Mississippi process 364,000 barrels of raw crude?per day, the 11th most in the country. Low carrying costs for fuel could therefore?also contribute to the state?s low gasoline prices. There is just a 19 cents per gallon tax for gas sold in Mississippi, the seventh-lowest in the country. The state also has no sales tax to drive up what people pay at the pump.

3. Alabama

  • Regular gas price per gallon:?$3.07
  • Tax per gallon:?20.9 cents (14th lowest)
  • Number of operating oil refineries:?3

Alabama has three major refineries that process 120,000 barrels of crude each day. The state also had a 36-cent decrease in gas prices last year -- the highest decline in the nation. Gasoline prices continue to drop rapidly in the state, with an 8 percent decline last month alone. Transportation costs in Alabama are the ninth lowest in the country, and the state has the eighth-lowest excise tax, at 16 cents per gallon.

4. Tennessee

  • Regular gas price per gallon:?$3.08
  • Tax per gallon:?21.4 cents (15th lowest)
  • Number of operating oil refineries:?1

Average gas prices in Tennessee have decreased by 9.7 percent in the past 12 months (the fourth-biggest decline in the country). In the past month alone, gas prices fell by 28 cents, an 8.3 percent decrease. According to the Cost of Living Index, low gas prices help drivers in Tennessee enjoy the seventh-lowest cost of transportation in the U.S. Tennessee drivers also pay the 15th-lowest state taxes on gas in the nation, at just 21.4 cents to the gallon, according to the American Petroleum Institute.

5. Louisiana

  • Regular gas price per gallon:?$3.16
  • Tax per gallon:?20 cents (tied for 12th lowest)
  • Number of oil refineries:?18

Louisiana is second to Texas in the number of oil refineries and gallons of oil processed per day, at more than 3.2 million barrels between its 18 major refineries. With close proximity to offshore drilling in the Gulf and the relatively low state tax on gas -- 20 cents per gallon -- Louisiana drivers pay some of the lowest gas prices in the nation.

Lawmakers reach compromise on roads, student loans

Facing weekend deadlines for action, congressional leaders have agreed to deals overhauling the nation's transportation programs without a Republican provision forcing approval of the proposed Keystone XL oil pipeline, and avoiding a doubling of interest rates for new student loans, congressional officials said Wednesday.

The agreements underscored the pressures both parties face to avoid angry voters and embarrassing headlines in the run-up to this November's presidential and congressional elections. Letting road-building programs grind to a halt during an economic downturn would be a blow to the image of lawmakers, while Democrats and Republicans alike seemed eager to avoid enraging millions of students and their parents by boosting the costs of college loans.

In contrast, enactment of the transportation measure would create or save 3 million jobs, said Sen. Barbara Boxer, D-Calif., chief sponsor of the Senate version of the bill. And the student loan measure would spare an estimated 7.4 million students who get subsidized Stafford loans beginning July 1 ? this Sunday ? from facing $1,000 in higher interest costs over the lives of their loans, which typically take over a decade to repay.

Congressional leaders were planning to combine the highway and student loan measures into a single bill to reduce potential procedural obstacles and hoped for final approval this week. Lawmakers would then leave Washington for a July 4 recess.

The two-year highway bill would prevent the government's authority to spend money on highways, bridges and transit systems from lapsing on Saturday, along with its ability to collect gasoline and diesel taxes. With both parties checkmating each other's top priorities this campaign season, Democrats and Republicans say the highway measure will be Congress' top job-creation initiative until the November elections.

"This is the jobs bill for the 112th Congress," said House Transportation Committee Chairman John Mica, R-Fla.

As the price for the highway agreement, lawmakers said Republicans dropped a House-approved provision requiring the government to approve the proposed Keystone pipeline, which is to move oil from western Canada to Texas' Gulf Coast.

Pipeline approval ? which prompted a veto threat from President Barack Obama ? has been a top goal this election year for the GOP, which has pitted its claims that it would create jobs against environmental worries that it could accelerate global warming and endanger Midwestern water supplies.

Republicans also agreed to abandon language blocking the Environmental Protection Agency from regulating the toxic ash generated by coal-fired power plants, lawmakers said. The ash is used as an ingredient in some types of cement.

In return, House Republicans won Senate concessions that would halve the time allowed for environmental reviews for highway projects, and squeeze money for bike paths and pedestrian safety projects by forcing them to compete with other transportation projects, said congressional aides and environmental lobbyists.

The bill would give states more flexibility in spending federal money, impose new safety regulations and expand a federal loan guarantee program to encourage private investments in transportation projects.

Despite the measure's short-term impact, the bill delays for two years decisions about a long-term funding scheme for highway and transit programs. Gas and diesel taxes no longer cover the cost of transportation programs and are forecast to bring in less revenue as the fuel efficiency of cars and trucks increases.

President Barack Obama spent weeks this spring touring college campuses and lambasting Republicans for not pushing a freeze on student loan rates through Congress. GOP presidential challenger Mitt Romney, looking to avoid handing Obama an issue, quickly said he favored the interest rate extension and congressional GOP leaders did too, though some Republicans think the government should not spend money to keep loan rates low.

The student loan pact would keep today's 3.4 percent interest rates on subsidized Stafford loans from doubling for new loans approved beginning on Sunday, an automatic increase that Congress enacted five years ago to save money. If they did double, it would affect 7.4 million students expected to get the loans over the 12 months beginning July 1, adding $1,000 to the interest costs of the typical borrower over each loan's life.

The tentative agreement was on the same package Senate Majority Leader Harry Reid, D-Nev., and Senate Minority Leader Mitch McConnell, R-Ky., had said Tuesday that they had shaken hands on, said a congressional Republican who spoke on condition of anonymity to describe the measure's status. McConnell said he expected the House to accept the agreement.

"We're moving, I think, towards an agreement on a transportation bill that would also include a one-year fix on the student loan rate increase," Boehner told reporters early Wednesday after meeting privately with House Republicans.

Some GOP lawmakers at that meeting said Boehner seemed to favor the emerging deal and said it received a positive reception.

"The general sense is there's a tremendous amount of support for getting it done," said Rep. Tom Reed, R-N.Y. "That's what's going to drive it across the finish line."

The two parties spent the last several weeks dueling over how to pay for the $6 billion cost of the student loan bill.

Under the agreement, the government would raise $5 billion by changing how companies calculate the money they have to set aside for pensions. That change would make their contributions more consistent from year to year and in effect reduce their payments initially, lowering the tax deductions they receive for their pension contributions.

Another $500 million would come from increasing the fees companies pay for the government to insure their pension plans, linking those fees to inflation.

In addition, $1.2 billion would be saved by limiting federal subsidies of Stafford loans to six years for undergraduates.

Lawmakers decided to wrap in another Senate bill to reauthorize the national flood insurance program for five years.

The program, which provides federally backed insurance for 5.6 million households and businesses, many in flood-prone areas, has gone deeply into the red from claims after Hurricane Katrina in 2005. The Senate legislation would try to return the program to fiscal soundness through such steps as allowing premium increases and reducing subsidies for vacation homes.

You'd be forgiven for assuming that the ModBook dream died with release of the first iPad. After all, the first version of the hacked notebook predated Apple's announcement by a couple of years. When the iPad finally hit in 2010, it did a lot to address the desire for a slate device running Apple software. Since then, things have largely remained silent on the Axiotron front. In fact, the last time we heard a significant peep out of the company was back in 2009. Its former CEO Andreas Haas assured us, however, that the real reason for the company's silence is a bit more complicated than the story of yet another product falling victim to the Apple steamroller.

"Axiotron itself was a great company," says Haas. "Back in 2008, I took the company public, everything was really great. There was one little thing that turned out to be a huge problem, which is that the company was largely bank-financed and 10 days after it went public, Lehman Brothers went belly-up and put the whole financial market in a tailspin. After that was mostly spent on trying to somehow restructure the company, and ultimately there was just nothing that could be done about it."

As the newly reborn Modbook Inc. teased via its Facebook page yesterday, however, the name lives on. This week marks the return of the tablet in the form of the 13.3-inch Modbook Pro, a device slated to ship early this fall. Can such a device survive in a world that's been downright flooded by tablets in the years since its predecessor's release? The company clearly feels it can -- that its new product is unique enough to set itself apart in amongst the deluge of slates, calling the new Pro, "the world's most powerful and largest-screen tablet computer." And in a space where hardware and software are relatively neutered, it's understandable how the company might be inclined to make such bold claims about the converted notebook.

    Google Nexus Q lets Android owners stream media from the cloud, shipping for $299 in mid-July

    ...And the Nexus Q is official. Google's first consumer electronics product is a small, sphere-shaped device that will work with the Nexus 7 tablet and other Android devices to stream media from the cloud. It's designed to hold court in your living room, pulling content from YouTube and the Google Play music app, among other services, to let you stream music and video. Anyone with an Android device will be able to take control of the Q to play content from their library; basically, everyone can be the DJ. What's more, the device can double as an amplifier, letting users plug in external speakers to receiver power from the Q's 25-watt amp.

    Under the hood, there's an OMAP 4460 processor -- the same as in the Galaxy Nexus -- along with 16GB of storage and 1GB of RAM. There's also dual-band WiFi and Ethernet, along with Bluetooth and NFC for tapping a device to the Q to exchange software and media. The media streamer will go on sale for $299 in mid-July. As we mentioned before, Google will also sell a set of $399 Triad bookshelf speakers to go with the Q. More coverage to follow -- in the meantime, check out Google's videos about the new product.

    Angels continue domination of Dodgers

    ANAHEIM, Calif. (AP) - The largest combined crowd in Angel Stadium history attended the three-game Freeway Series, with Angels and Dodgers fans sharing rows and alternating chants throughout a boisterous weekend.

    Everybody left Anaheim on Sunday with another confirmation of the current standings in Los Angeles baseball. Although the Dodgers are leading the NL, the Angels are firmly on top of this rivalry.

    Mark Trumbo drove in Albert Pujols with the tiebreaking run in the seventh inning, and the Angels won their series with the Dodgers for the third straight year with a 5-3 victory Sunday.

    Peter Bourjos hit an early two-run homer and Howie Kendrick added another RBI single in the seventh for the Angels, who took four of six from the Dodgers in the past two weeks - including two of three this weekend in front of a combined 133,035 fans.

    The Angels haven't lost the local derby since 2006, and they've won 13 of their last 18 games against the Dodgers, who have the NL's best record. Just don't ask former Dodgers catcher Mike Scioscia if it means anything.

    "We've been a better ballclub as the season has gone on, and that has to continue," said the Angels manager, ejected in the fifth inning for arguing a call at third base. "It doesn't matter who we're playing or where we're playing, but how we're playing. ... We certainly had some mistakes and some calls that didn't go our way, but we played at a high enough level and got enough clutch hits to absorb it."

    Scott Downs (1-0) pitched one hitless inning of relief, and Ernesto Frieri got four outs to earn his ninth save for the Angels, who have won 11 of 15 and 22 of 30 while surging up the standings over the last month. Frieri struck out Gordon with a runner on second base to end it.

    The Angels also cemented their spot as the majors' best interleague team since the start of the 2007 season, improving to 74-34 after going 12-6 against NL clubs this season. The Angels have won 14 of their last 15 interleague series overall.

    Pujols drove in Mike Trout with a go-ahead run in the fifth inning moments before Scioscia was ejected. Juan Rivera doubled and scored on Adam Kennedy's flyout to even it for the Dodgers in the sixth.

    Trumbo and Kendrick then capped a two-out rally against Dodgers reliever Josh Lindblom (2-2) with singles, driving home Pujols and Kendrys Morales.

    "Our chemistry has always been there, but it's always more fun when you're winning a lot of games," said Trumbo, who impressively connected with an inside fastball for his big hit.

    Bobby Abreu and Dee Gordon drove in early runs for the slumping Dodgers, who have lost six of their last eight games. Both teams dropped playable popups and endured close umpiring calls, but the Dodgers couldn't match the Angels' late-game execution while losing their sixth straight series to the Angels.

    "It seems like wherever I've been, to be honest, we've had trouble with those guys," said Dodgers manager Don Mattingly, a coach with Joe Torre's Yankees when the Angels constantly gave trouble to New York. "They're a good club, and they've had good clubs, and there's a reason why. They've got talent, they come after you and they're aggressive."

    Garrett Richards struggled through much of his seventh career start for the Angels after giving up just two earned runs in his previous four starts while ace Jered Weaver was on the disabled list. The rookie, who's still in the rotation with Jerome Williams on the DL with breathing problems, hung on into the seventh while yielding nine hits and two walks, striking out five.

    Aaron Harang yielded eight hits and three runs in six innings for the Dodgers, walking just two Angels after issuing a career-high eight walks in his last start in Oakland.

    All three former Angels in the Dodgers' starting lineup contributed. Abreu hurt the team that's still paying his exorbitant salary with a run-scoring single in the first, while Rivera and Kennedy teamed up for a run in the sixth.

    Bourjos evened it in the second with a shot into the bullpen in left field, connecting a few pitches after his drive down the right-field line was mistakenly ruled foul. Bourjos has been struggling for consistent playing time and hadn't homered since his inside-the-park shot in Minnesota on April 11.

    Pujols started the Angels' seventh-inning rally by drawing his 1,000th career walk, becoming the 12th active major leaguer to reach the milestone.

    "I basically beat myself, getting two quick outs and then giving in to Pujols in that situation," Lindblom said. "Then I hit Morales, and everything just kind of steamrolled from that point. They're a great lineup."

    The government has passed a new amendment to its copyright laws, making illegal downloading punishable with jail terms for the first time.

    The new law applies to those found in possession of pirated material such as music, DVDs or Blu-ray discs, and could result in fines of up to 2 million yen and sentences of up to two years in prison, according to CNET Japan.

    The changes to the law bring Japan in line with the U.S., where downloading is already a criminal offense and punishments are even more severe. U.S. criminal penalties can run up to 5 years in prison or a $250,000 fine, 10 times higher than Japan.

    The move has been welcomed by music industry figures, but has caused some concern among legal experts, NTV reported. The government claims the move has been introduced to protect people making music. Warner Music Japan CEO Keiichi Ishizaka has been quoted in the press as saying that he would like to see all illegal downloading eradicated.

    The new amendment makes illegal downloading truly punishable for the first time. The downloading of copyrighted material without permission has been illegal in Japan since 2009, but as a civil matter, rather than a criminal one. As a result, punishments were restricted to those who uploaded pirated content. Uploaders were liable to face penalties of up to 10 years in prison or fines of as much as 10 million yen.

    The bill passed the Lower House last Wednesday with little opposition, and passed the Upper House by a vote of 221 to 12, NTV reported. One of the few opponents of the bill, Takeshi Miyamoto, suggested although illegal downloading was a problem, a more effective approach to eradicating the practice would be to establish systems to efficiently remove illegal content, rather than to focus on punishment.

    Meanwhile, NHK reports that some legal experts have expressed concern that the bill?s unclear wording could lead to unfair and unnecessary prosecutions. The bill says that a person who is aware that the the download or stream results in a copyright infringement can face charges. As a result, even watching a YouTube video could result in prosecution if the viewer is aware that streaming the media is illegal.

    Some groups, including the Japan Federation of Bar Associations, have suggested that this may be an excessive measure in a country that still relies on the sales and rentals of physical media and has seen a relatively slow uptake of legal download services.

    Upper House member Yuko Mori, another opponent of the amendment, was widely quoted in the Japanese press as saying, ?We shouldn?t risk making the general public, including young people, the subject of criminal investigations.?

    The Recording Industry Association of Japan (RIAJ) said it believes the amendments are good for the industry, and that it will strive to make the public aware of the new rules and penalties, the Nikkei reported. RIAJ chairman and CEO of Sony Music Entertainment Japan Naoki Kitagawa claimed the changes would ?reduce the spread of copyright infringement activities on the Internet.?

    The new law will come into effect in October.

    Analysis: Sandusky's lawyer jeopardized his client's interests

    The law is pretty clear on a lawyer's ethical duty when he makes statements regarding his clients. The lawyer may neither divulge confidences nor make statements adverse to the client's interests.

    The rule is clear enough, but it is violated all the time in innocuous ways. Lawyers go home to their wives and describe the horrifying day they had. They gather with other lawyers in corridors of courthouse or in local watering holes and tell stories about their cases. Arguably, lawyers could be seeking advice from their professional colleagues, thus including them in the attorney-client privilege, but usually they're just telling stories.


    In short, lawyers do describe to their friends facts surrounding their cases, and those discussions often evaluate the strength of their cases. Ideally, and most often, they omit the names of their clients, but their listeners are frequently able to identify them. One very famous lawyer routinely jokes about his former client's guilt. Alan Dershowitz said to his criminal law class at Harvard: "If O.J. does it again. ... By that, I mean gets another speeding ticket."

    It's not appropriate, and I don't teach my students that this is acceptable, but for a lot of lawyers it is the reality. And it would be difficult if not impossible to police the actual rule that forbids any negative statement.

    Friday, however, Joe Amendola told a crowd of reporters in the Centre County Courthouse awaiting the verdict that he would be shocked if his client was acquitted of all the counts.

    This after months of denying Sandusky's guilt. This after an impassioned and excellent closing argument in which he explained how all the alleged victims had fallen prey to investigators' coaching and then sought to cash in.

    And, perhaps most significantly, after the judge issued a gag order expressing forbidding anyone in the case from commenting on Sandusky's guilt or innocence.

    This wasn't a comment to fellow lawyers who are unlikely to have any reason to communicate the information to others. This wasn't a private communication to his wife. His statements were made in a mini-press conference in the courtroom where his client had stood trial and where the jury could come and announce its verdict at any time. His comments were made to reporters who have the right ? arguably the obligation ? to report his words to a national audience that has been captivated by this case.

    This wasn't a comment that could never harm his client, in other words. There could be a hung jury, necessitating another trial. And there will surely be civil lawsuits. Amendola's comments, which will be heard throughout Centre County and around the country, could easily prejudice his clients' future interests.

    Finally, and perhaps most significantly, this isn't a comment for which there is no ready enforcement mechanism. It is unlikely that Sandusky will file a complaint with the ethics board. But Judge John Cleland, who maintained very strict control over this trial, issued a specific order forbidding comments on guilt or innocence.

    Certainly, he must have anticipated the prosecution's making disparaging comments about Sandusky, but his order didn't allow an exception for Sandusky's lawyer to suggest his own client's guilt. Cleland may well regard this as a breach of the decorum he has worked so hard to maintain. And unlike an ethics board, he has the ability to act swiftly and the power to hold Amendola in contempt.
